These Terms of Service ("Terms") govern your use of Lifetime Tax Planner (the "Service"), operated by Decision Continuum LLC ("we," "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Service is an educational modeling tool. It computes hypothetical projections from information you provide, using published tax rules and documented assumptions. The Service does not provide tax, legal, accounting, investment, or financial advice; no output is a recommendation to take any action; and your use of the Service creates no professional, advisory, or fiduciary relationship. See the Disclaimer, which is part of these Terms.
Lifetime Tax Planner is intended for adults who are at least 18 years old and legally capable of entering into a binding agreement. Individuals under 18 may not use the Service independently. An adult may enter information concerning a minor dependent when authorized to do so.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that projections are accurate, that the model reflects current law at all times, or that the Service will be uninterrupted or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Decision Continuum LLC AND ITS MEMBERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, SAVINGS, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING DECISIONS MADE IN RELIANCE ON ITS OUTPUTS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (WHICH, FOR A FREE SERVICE, IS ZERO) OR ONE HUNDRED DOLLARS, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the fullest extent permitted.
The Service, including its software, methodology, content, and branding, is owned by Decision Continuum LLC and protected by intellectual-property law, including pending patent applications. You retain all rights to the data you enter (which, again, we never receive). We grant you a personal, non-exclusive, revocable license to use the Service for your own planning education.
The Service, including its software, calculation engine, methodology descriptions, text, and design, is protected by copyright, patent (patent-pending), and other intellectual-property laws. Except as expressly permitted by these Terms or by law that cannot be contractually waived, you agree that you will not, and will not assist or permit any third party to:
Nothing in this section limits uses that applicable law expressly permits notwithstanding contractual prohibition (for example, interoperability rights in some jurisdictions); nothing in it restricts you from viewing, discussing, or criticizing the Service's publicly displayed results from your own ordinary use; and nothing in it restricts the use of assistive technologies (such as screen readers or browser accessibility tools) in your own ordinary use of the Service.
We may modify or discontinue the Service at any time. We may update these Terms; the date above reflects the latest version, and continued use after changes constitutes acceptance. Material changes to data practices will additionally follow the process in the Privacy Policy.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in Knox County, Tennessee, and you consent to their jurisdiction.
If any provision of these Terms is held unenforceable, the remainder stays in effect. These Terms, the Privacy Policy, and the Disclaimer are the entire agreement between you and us regarding the Service. Failure to enforce a provision is not a waiver.
